DecisionsCourt reverses special findings for special immigrant juvenile status application denial

In Matter of Lavdie H. v Saimira V. the appeals court reversed the trial court’s refusal to consider evidence occurring after a child’s 18th birthday but prior to the child’s 21st birthday.

This carries a recent trend of a liberal interpretation of statutes and case law surrounding the court’s ability to grant guardianship for persons over 18 but under 21, as well as similar interpretation for the special findings required for young persons to petition immigration courts for special immigrant juvenile status.
