DecisionsPartial modification on termination proceeding is a victory for children’s rights

In termination of parental rights cases – there is a trial on the merits (to be proved by clear and convincing evidence) and then a dispositional hearing as to the best interests of the child/ren (by a preponderance of the evidence).

In Matter of Shilloh M.J (Jamesina M.J.) the appellate court found that permanent neglect was proved and, for all-but-one of the children, adoption was determined at disposition to be in the children’s best interests as they remained in the same pre-adoptive foster home. However, it seems that one child had changed homes during the course of the appeal and no longer consented to be adopted – the appeals court therefore his case was remanded back for a new dispositional hearing.
