Things We Think About

BlogUnanimous victory on our appeal

August 2, 2020

The decision is here.

This was not, by a long shot, our first time at the appellate division. It was, however, the first case we have taken from trial through the entire briefing process and final decision.

We’ve argued numerous interim applications for temporary orders and relief, we’ve brought motions for stays and for permission to appeal (when the law says you are not granted the right automatically).

But the actually briefing process is more involved than a single motion – the process is much more involved and requires ordering and reviewing the trial record, outlining and strategizing about what has the greatest likelihood of success (for example – do you nitpick the entire record and call out every issue, or do you take a more focused, honed approach).

Briefs take a while to draft. Then they need to be proofread and edited, citations need to be added, and the particular formats for briefs must be followed.

It was a challenging and exciting experience and we look forward to taking on further appeals cases.
