DecisionsDuration of temporary order of protection, not dispositive of length of final order

Let’s face it – trials take time to prepare for and even special proceedings are often delayed in proceeding to a fact-finding hearing. Sometimes it takes months, or even years, to go to trial. The appellate division this week ruled that having a temporary order of protection during that time does not, on its own, factor into the length of a final order of protection. The case is Matter of Sheila N. v Rudy N. and the case included a temporary exclusion from the home followed by a two-year non-exclusionary order of protection that did not mandate the respondent stay away from the petitioner.
