In Matter of Johnell E.K. v Fatima T. the Court reaffirmed that the review basis of a custody determination is whether there was a sound and substantial basis in the record for the trial court’s decision. In this case, the child was residing with the father since 2014 and the father had been handling education and medical decision making during that time including following up with, and administering, asthma medication. The father had facilitated contact with the then-noncustodial parent, whereas the mother had attempted to interfere with the father’s visitation, had provided no support, and disbelieved the asthma diagnosis.
